Carmine (“Company,” “we,” “us,” or “our”) provides an online real estate platform that connects buyers, sellers, renters, and agents. These Terms of Service (“Terms”) govern your access to and use of our platform, website, and related applications (collectively, the the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use our Service.

Carmine is designed to help you search for homes, understand the market, connect with agents, and list or manage properties. You must be at least 18 years of age to use the Service. You agree to use the Service only for lawful purposes and in compliance with all applicable regulations. You may not use the Service to misrepresent yourself, post misleading listings, harvest data, or interfere with the normal operation of the platform.

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and up-to-date information during registration and to update it as needed. Carmine is not liable for any loss or damage arising from your failure to protect your account or from unauthorized access to it.

When you list a property, you confirm that you have the right to do so and that the information, photos, and media you provide are accurate and do not infringe the rights of others. You remain responsible for the content you post. Carmine may review listings for compliance and reserves the right to remove content that violates these Terms, our policies, or applicable law.

All content and materials on the Service, including our brand, logos, interface design, and original data compilations, are owned by Carmine or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, or resell any part of the Service without our prior written consent.

Access to certain features of the Service may require a subscription or the purchase of credits, such as premium listing placement or drone photography services. All purchases are final unless otherwise stated in our Refund Policy. We use trusted third-party payment processors, and we do not store your payment card information. By making a purchase, you agree to pay all charges associated with your account, and you authorize us to charge your selected payment method.

Agents and property owners are expected to maintain professional standards of honesty and transparency. You agree to provide accurate information, respond to inquiries in a timely manner, and represent properties fairly. Failure to meet these standards may result in the suspension or removal of listings or accounts at our discretion.

We retain your data, including account information, saved searches, and uploaded media, as necessary to provide the Service and comply with legal obligations. You may request deletion of your data by contacting us. Upon account deletion, we will remove your personal data within a reasonable timeframe, subject to any legal requirements to retain certain records.

The Service may integrate with third-party tools and platforms, such as payment processors, map and data providers, and hosting services. We are not responsible for the practices, content, or availability of third-party services. Your use of third-party services is subject to their respective terms and policies.

To the fullest extent permitted by law, Carmine shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of, or inability to use, the Service. This includes, without limitation, loss of profits, data, or goodwill. Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website, and the updated Terms will apply to your use of the Service from that point forward. Continued use of the Service after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
